GOODRIDGE: ENERGIZER?--Joshua Baker

I have to tell you how energized I was reading the Sosman and Cordy dissents yesterday. Even though we lost the battle, I read the dissents as a sign that the tide in the war is beginning to turn. There was a time when the best we could hope for was a judge who would stake his/her claim on the rather dry idea of separation of powers. Now, we're actually getting judges to say that marriage is important to our society. If the justices are willing to make these arguments, perhaps state AG's will be more willing to argue that way as well.
