COMMON-LAW MARRIAGE: Ben Bateman

It’s hard to generalize about state laws on common-law marriage. In Texas we call it informal marriage (or at least the statute does), and there is no required time. The couple need merely 1) agree to be married, 2) hold themselves out as married, and 3) live in Texas. You can read the statute here.

This doesn't really change your point, but we conservatives must be careful with the details.
